Pay rules in Virginia
Minimum wage. Virginia's minimum wage is $12.77 an hour, in effect since January 1, 2026. Babysitters working fewer than 10 hours a week are not covered by Virginia's minimum wage. Scheduled: $13.75 in 2027, $15.00 in 2028.
Casual babysitting (irregular or occasional, usually 20 hours a week or less, and not the sitter’s vocation) is exempt from the federal minimum wage and overtime. Nannies and regular sitters are covered: at least $12.77/hr for every hour under Virginia law where it applies, and never less than the federal $7.25, plus overtime at 1.5× after 40 hours in a week unless they live in your home.
